Schrems v Meta (data minimisation)

In plain English

Data minimisation stops a social network from gathering and using all personal data, on and off the platform, for targeted advertising without limits of time or type. Speaking publicly about one's sexual orientation does not let the network use other data about it for ads.

  • Maximilian Schrems v Meta Platforms Ireland Limited

  • ECLI:EU:C:2024:834

What the court ruled

the principle of data minimisation provided for therein precludes any personal data obtained by a controller, such as the operator of an online social network platform, … from being aggregated, analysed and processed for the purposes of targeted advertising without restriction as to time and without distinction as to type of data.
